Deliveries

We consider ensuring the right to the protection of personal data as a fundamental ETA2U commitment, therefore we will dedicate all the necessary resources and efforts to process your data in full compliance with Regulation (EU) 2016/679 ("General Data Protection Regulation" or " GDPR"), as well as with any other legislation applicable on the territory of Romania.

 

1.    Data operator

ETA2U SRL, with registered office in Timisoara, str. Gheorghe Dima no. 1, with order number in the Trade Register J35/703/1992, unique tax registration code RO1801821 (hereinafter "ETA2U" or "we").

 

2.    Purposes and grounds of processing

The purpose of processing your data:

2.1 For online orders.

This general purpose may include, as appropriate, the following:

  •  Account creation and administration within the eta2u platform;
  •  Order processing, including receiving, validating, shipping and invoicing them;
  •  Solving cancellations or problems of any nature related to an order, to the purchased products;
  •  Returning products according to legal provisions;
  •  Reimbursement of the counter value of the products according to the legal provisions;
  •  Providing support services, including providing answers to your questions about your orders or eta2u products

The method of processing and the duration of storage of personal data

ETA2U processes personal data in accordance with the principles of legality, fairness and transparency. Your personal data is processed through the following operations: collection, recording, organization, structuring, storage, consultation, adaptation or modification, use, disclosure by transmission, retrieval, alignment or combination, restriction, deletion or destruction of data. Your personal data is subject to both hard copy and electronic processing.

As a rule, we will store your personal data as long as you have an account on the eta2u platform. Regarding the personal data you have provided us by placing your order online, it is kept in accordance with accounting legislation, namely 10 years. You may request that we delete certain information or close your account at any time, and we will comply with such requests, subject to maintaining the above information including after your account is closed.

3.   Security of personal data

ETA2U S.R.L. applies the necessary technical and organizational measures in the use of your personal data in order to ensure their security, protection against accidental or illegal destruction, modification, disclosure or unauthorized access.

The transmission of information over the Internet, in general, or through other public networks, is not completely secure, and there is a risk that the data may be seen and used by unauthorized third parties. In this context, we cannot be responsible for such vulnerabilities of systems that are not under our control.

 

4. The rights of the data subject

  •  Right of access to data processing – You have the right to access the personal data we hold. The first provision of information will be made free of charge. If you require further copies of information already provided, we may charge a reasonable fee considering the administrative costs of providing the information. Manifestly unfounded, excessive, or repeated requests may not receive a response.
  •  Right to data rectification – You have the right to request that your Data be rectified if it is inaccurate or out of date and/or complete if it is incomplete.
  •  The right to data erasure (“the right to be forgotten”) – In some cases, you have the right to obtain the erasure or destruction of your Data. This is not an absolute right as we may sometimes be forced to retain your Data for legal or legal reasons.
  •  The right to restriction of processing – You have the right to request the restriction of processing of your Data. This means that the processing of your Data is limited so that we may retain the Data but not use or process it. This right applies in specific circumstances provided for by the General Data Protection Regulation, namely:
    • the accuracy of the Data is disputed by the data subject (i.e. you), for a period that allows the operator (i.e. ETA2U) to verify the correctness of the Data;
    • the processing is unlawful and the data subject (i.e. you) opposes the deletion of the Data and requests the restriction of its use;
    • the operator (e.g. ETA2U) no longer needs the Data for processing, but it is requested by the data subject (i.e. you) for the establishment, exercise or defense of legal claim;
    • the data subject (i.e., you) has objected to processing based on legitimate grounds by the controller (in this case ETA2U), based on the verification that the legitimate grounds of the controller (ETA2U) outweigh those of the data subject (i.e. you.
  • Right to data portability – You have the right to move, copy or transfer the data you are interested in from our database to another. This only applies to data that you have provided, where the processing is based on your consent or based on a contract and is implemented by automated means.
  • The right to object – You can object at any time to the processing of your data when such processing is based on a legitimate interest. 
  • Right to withdraw consent at any time – You may withdraw your consent in relation to the processing of your data where such processing is based on consent. Withdrawal of consent does not affect the lawfulness of processing based on consent prior to its withdrawal. 
  • The right to file a complaint with the competent supervisory authority – You have the right to file a complaint with the data protection authority of your country of residence or domicile to challenge the data protection practices offered by ETA2U.

  • § The right to object to the processing of your data for direct marketing purposes – ou can unsubscribe or opt out of our direct marketing communication at any time. It's easiest to do this by clicking on the "unsubscribe" link in any email or communication we send you.
  • § The right to object to the processing of your data by us when we carry out actions in the public interest or in our own or a third party's legitimate interests – You can object at any time to the processing of your data when such processing is based on a legitimate interest.

Response time to your request: Within a maximum of one month calculated from the receipt of your request, you will be provided with information on the actions taken or, where appropriate, on the reasons why the requested measures cannot be taken.

 

Note: Please keep in mind that to comply with a request for access to personal data, we will take all reasonable measures to verify the identity of the person concerned. Also, according to the GDPR Regulation, the response deadline mentioned above can be extended by a maximum of two months in the situation where it is necessary, considering the complexity and number of requests, and we will inform you about this aspect, if you be the case.
