These Terms and Conditions define the terms of use of the magazin.eta2u.ro website by potential visitors or customers.

The object

This document presents the general online sales conditions via the magazin.eta2u.ro website. Sales are carried out by the company ETA2U S.R.L.

These general conditions, excluding the exceptions expressly specified in writing, regulate the relationship between magazin.eta2u.ro and the client, legal or natural person.

Definitions

• “Site/Webshop” represents the online platform or online shop.
• “Seller” identifies the company S.C. ETA2U S.R.L., with registered office in 1 Gh. Dima str., Timisoara, Timis county, CUI RO1801821, registration number at the Trade Registry J35/703/1992.
• “User” identifies the subject, legal or physical person, who has access to the site's content.
• “Customer” identifies any natural/legal person registered on the Site, who, by completing the Account creation process, agreed to the site-specific clauses in the Terms and Conditions of Sale section.
•  “Account” represents the section of the Site that contains the identification data of the Client, and which can only be accessed by him based on an e-mail address and password
• “Order” is an electronic document that intervenes as a form of communication between the Seller and the Customer through which the Customer transmits to the Seller, through the Website, his intention to purchase Goods and Services from the Website.
• “Contract” represents the remote contract concluded between the Seller and the Customer, without the simultaneous physical presence of the Seller and the Customer.
•  “Force Majeure Events” include, as an example, but are not limited to, situations resulting from (directly or indirectly) any strike, blockade, fire, flood, impossibility of obtaining products, delays of suppliers or couriers, laws or government regulations or any other cause or event that is not under the Seller's control.
• “Working days” refers to the days when the Seller's departments are open for carrying out the activity (every day from 9 am to 6 pm, excluding Saturdays, Sundays, legal holidays).

Non-engagement of liability

The content of the information refers to the description in a certain degree of detail of the products and services offered by the Seller.

The seller will not give any warranty regarding:
a) avoiding arduous use or interruption in use of the site;
b) not negatively affecting other systems by using the site;
c) he non-existence of viruses or other components that could harm users on the website.

Thus, the Seller cannot be held responsible for any direct or indirect damages caused by the use of its Website.

The seller cannot be held responsible for the damages caused by the errors, inaccuracy or non-updating of the information published or maintained on the Site, which is not due to his fault.

The seller does not assume responsibility for the correctness of the information on the characteristics of the products presented on the Site. This information is taken over/made available by producers/suppliers.

The images displayed on the Site are informative and do not create contractual obligations. The ordered products may differ from the displayed images in any way (color, appearance), due to changes in the characteristics or design, without prior notification by the manufacturers.

Rights to the content of the Site/Webshop

All the information, products or applications contained in this Site are the property of the Seller, who reserves the right to modify the content and/or structure of the Site at any time and without any prior notice.

The entire content of the Site is protected by the Copyright Law, all rights being reserved. All rights related to the pages, content and presentation of the Site are owned by the Seller. It is forbidden to copy, modify, display, distribute, transmit, publish, sell, license, create derivative materials or use the content of the Site for any purpose without written confirmation from the Seller.

Information about products

All available products/services are described in detail on the Site page. We try to present and describe as accurately as possible each feature of the products. We reserve the right to modify product specifications, prices and associated services at any time and without notice. Before ordering, we invite you to carefully check the characteristics of the products/services. We do our best to offer you the best content (images, descriptions), but we cannot guarantee that the details and color of the images on the Site are 100% true. Depending on the Internet browser or monitor used, it is possible that sometimes there are small display differences. This may also be due to the technical process of resizing the images, which leads to a reduction in the quality of the images present on the Site.

Acceptance of the Order/conclusion of the Contract

The Site will send a notification to the Customer's e-mail address informing the Customer that the Order request has been registered. At this moment, if he wants to change the Order, the Customer can contact the Seller by email. At this stage, both the customer and the Seller have the possibility to modify or cancel (delete) the Order request. After registering the request, the necessary checks are made, and the Customer will receive a written confirmation of the Order. After confirming the Order, it cannot be canceled directly from the website. When the Order has been processed and delivered to the courier for delivery to the Customer, the Customer will receive another notification containing the Order number, the name of the courier and the AWB code for tracking the package.

By ordering the products, the Customer agrees that the Seller can contact him, by any means available / agreed by the Seller, in any situation in which it is necessary to contact the Customer.

Prices

All prices on the Site include VAT.  For the issuance of an invoice, the information provided by the Customer when placing the Order will be considered true. The prices displayed on the Site are the prices in force at this moment. The price of the products on the Site does not include shipping costs.

The seller makes every effort to provide correct information about the price and characteristics of the products. It is possible that some prices and/or features are incorrect. In case of possible errors, the Customer will be informed of the changes proposed by the Seller. If the Customer does not agree with the Seller's proposals, the Seller has the right to cancel the Customer's order.

Payment Terms

Payment term is agreed and detailed upon signed contract between Customer and Seller.

Delivery

The ordered products are delivered via ETA2U transportation or via courier services. In the case of products that are brought to order, the estimated delivery time is communicated at the time of confirmation of the Order.

Any delays or inability to deliver may occur in the case of Force Majeure Events. In these cases, we will do all the steps, so that the Customer gets possession of the Order as quickly as possible. If the goods sent by courier do not arrive within the specified time, the Customer will first have to contact the courier with the AWB number received, and if the problem is not resolved, contact the Seller by e-mail.

From the moment you take physical possession of the product, the risk of loss or damage to the products is fully transferred to you. Any subsequent complaint will be taken into consideration in special conditions.

Guarantees

All products sold on the Site benefit from warranty conditions in accordance with the legislation in force and the commercial policies of the manufacturers and are accompanied by a certificate of conformity and the Seller's warranty certificate. For warranty issues, the products will be sent by courier, to the address Strada Gheorghe Dima, number 1, postal code 300079, Timisoara, Timis county, Romania.

The cost of sending the defective product to the service will be borne by the Customer, and the cost of sending the repaired product to the Customer will be borne by the Seller.

Applicable law – Jurisdiction

This Agreement is subject to Romanian law. Any disputes arising between the Seller and Customers will be resolved amicably or, if this is not possible, the disputes will be settled by the competent Romanian courts of the Seller's place of residence and/or domicile.
